NASCAR has described these actions as an “illegal cartel” aimed at disrupting the Charter system, which operates similarly to a franchise model.
Curtis Polk, named as the mastermind behind this strategy, is accused of negotiating on behalf of all teams, coordinating their actions, and discouraging teams from breaking away. NASCAR also claims that Polk’s interference hindered the organization’s ability to secure new media rights deals. In response, NASCAR is seeking to revoke guaranteed starting spots for charter teams if the accused parties continue challenging the legality of the Charter Agreements under antitrust laws.
23XI Racing’s Background
Founded in 2020 by Michael Jordan and NASCAR driver Denny Hamlin, 23XI Racing entered the sport after purchasing a charter from Germain Racing. The team currently fields two full-time cars in the NASCAR Cup Series—Bubba Wallace drives the No. 23 car, while Tyler Reddick pilots the No. 45 car. Additionally, the team runs the No. 50 car for part-time drivers, further expanding its presence in the series.
